Prenuptial Agreement
Everyone getting married today should enter into prenuptial agreement. No one enters into a marriage believing that it will end in divorce, however, we know that statistically it is something that may unfortunately happen. The prenuptial agreement is a per-marital contract that goes into effect once you are married and can help you and your fiancé resolve certain future financial issues now when you are not in a hostile situation. If you never divorce, then the issue is mute but if the relationship ever dissolves, it can be an invaluable contract to have in place. The prenuptial agreement gives you and your fiancé the freedom to decide your financial future without having to have a Judge decide for you in the future.
While everyone getting married should enter into a prenuptial agreement, if at the time you are contemplating marriage, you are already established in your business or career, and/or you own any property or stand to inherit any property and/or have children from a previous relationship, you must enter into a prenuptial agreement if you want to protect your assets in the event of a divorce.
Prenuptial Agreements can be very complex and each agreement should be tailored to meet the specific needs, interests and concerns of the client. It is essential that you work with an experienced attorney that not only has a thorough knowledge of matrimonial law, but that knows how to negotiate these very sensitive documents. Ella Royzman has the legal knowledge and the personal ability to navigate you through this process so that you accomplish your goals and remain a happy about to be married couple.

Post-nuptial Agreements
A post-nuptial agreement is a marital contract that is entered into by spouses after marriage. People may choose to enter these agreements because they never had the opportunity to enter into a pre-nuptial agreement before marriage, but would still like to protect certain assets and decide for themselves how their financial issues will be resolved in the event of a divorce. Another reasons people may choose to enter into a post-nuptial agreement is because something occurred financially during the marriage which the parties wish to document and decide now it will be resolved in the event of a divorce in the future. As an example, perhaps one spouse started a new business with a partner or several partners and it is necessary to define what rights the non-business spouse will have to that asset in the event of a divorce. Or perhaps the parties purchased a home with a partial gift from a family member who wants to ensure that in the event of a divorce, their gift will be credited to one spouse and not both parties. There are numerous such scenarios that could arise during a marriage. It is imperative to work with our experienced attorney, Ella Royzman, now who can assist you in preparing a post-nuptial agreement in order to document your intent and determine your rights now, rather than fight in the future.
Cohabitation Agreements
Cohabitation agreements are written contracts entered into by two people who are not married to each other but are living together in a romantic relationship. No one wants to imagine their relationship coming to an end but sadly, we know this can happen. That is why it is important for you and your partner to set down your intentions when things are amicable. Now is the time to address your personal and financial issues. Living with someone without this type of agreement can be very risky and in the worst scenario, financially disastrous. Like all contracts, it is imperative that you work with a knowledgeable and experienced attorney representing you.
